Terms of Service & Release of Liability

1. About Launchstr

Launchstr is a marketing services company operated by Apache Legacy Group LLC, an Arizona limited liability company. We provide short-term rental (STR) owners with custom websites, social media content creation and scheduling, booking platform integration assistance, and related digital marketing services.

Launchstr is not a property management company, co-host, rental operator, or hospitality service. We have no authority over, and accept no responsibility for, the physical condition, operation, or safety of any property we provide services for.

2. Services Provided

By purchasing a Launchstr package, you ("Client" or "Owner") engage Apache Legacy Group LLC for the following services, as described in your selected package:

• Custom website design and development
• Instagram account setup, branding, and/or content strategy
• AI-assisted content research and draft creation (posts, captions, stories)
• Social media scheduling and queue management via third-party tools
• Booking platform integration assistance (PMS linking, widget setup)
• Ongoing content pipeline management (Growth and Premium tiers)

All services are marketing services only. Launchstr does not accept, process, or manage guest reservations on your behalf, nor does Launchstr handle guest communications, check-in, check-out, or any operational aspect of your rental property.

3. Owner Representations and Warranties

By purchasing Launchstr services, you represent, warrant, and agree that:

• You are the lawful owner or authorized operator of the property described in your intake form.
• All information, photos, and content you provide to Launchstr is accurate, truthful, and does not infringe on any third-party rights.
• Your property complies with all applicable local, state, and federal laws, including STR permitting and licensing requirements.
• You maintain adequate short-term rental insurance coverage (homeowner's, STR-specific, or commercial liability) sufficient to cover guest injuries, property damage, and related claims.
• You are solely responsible for the physical safety and maintenance of your property and all amenities listed or advertised.
• You will not use Launchstr's marketing materials to misrepresent your property's condition, safety features, or availability.

4. Release of Liability

To the fullest extent permitted by applicable law, Client hereby releases, waives, discharges, and holds harmless Apache Legacy Group LLC, its members, managers, employees, contractors, and agents (collectively "Launchstr") from any and all claims, demands, damages, losses, costs, and expenses of any kind, including but not limited to:

• Personal injury, illness, or death of any guest, visitor, or third party at or related to the property;
• Damage to, destruction of, or theft of any property belonging to any guest, visitor, or third party;
• Claims arising from HOA violations, zoning violations, STR licensing violations, or other regulatory non-compliance;
• Claims arising from inaccurate or misleading property information provided by the Client to Launchstr;
• Claims arising from the content of any website, social media post, or marketing material created by Launchstr using Client-provided information;
• Any loss of revenue, bookings, or business resulting from the use or performance of Launchstr's marketing services;
• Any claims made by guests who booked through a direct booking website or social media channel operated by Launchstr on behalf of the Client.

5. Indemnification

Client agrees to defend, indemnify, and hold harmless Apache Legacy Group LLC and its affiliates from and against any and all third-party claims, lawsuits, demands, liabilities, damages, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Any guest stay, injury, illness, or death at Client's property;
• Client's breach of these Terms;
• Client's violation of any applicable law, regulation, or ordinance;
• Any inaccurate information provided to Launchstr by the Client;
• Client's failure to maintain adequate insurance coverage.

6. No Guarantee of Results

Launchstr makes no warranties, express or implied, regarding the number of bookings, revenue, website traffic, social media growth, or any other measurable outcome resulting from our services. Marketing results depend on many factors outside our control, including but not limited to market conditions, property desirability, pricing, competition, and platform algorithms.

7. Content Accuracy

All website copy, social media content, and marketing materials created by Launchstr are based solely on information provided by the Client in the intake form and during the engagement. Launchstr does not independently verify property conditions, amenity availability, safety compliance, or any other factual claims made in Client-provided materials. Client is solely responsible for the accuracy of all information provided to Launchstr and for the real-world accuracy of any claims published in resulting marketing materials.

8. Limitation of Liability

In no event shall Apache Legacy Group LLC's total liability to Client for any claim arising under or related to these Terms exceed the total fees paid by Client to Launchstr in the three (3) months immediately preceding the event giving rise to the claim. In no event shall Launchstr be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or lost bookings.

9. Independent Contractor Relationship

Launchstr is an independent contractor. Nothing in these Terms creates any partnership, joint venture, agency, franchise, or employment relationship between Launchstr and Client. Launchstr has no authority to bind Client to any third-party agreement, and Client has no authority to bind Launchstr to any third-party obligation.

10. Intellectual Property

Upon payment in full, Client receives a non-exclusive, perpetual license to use the website design, content, and marketing materials created by Launchstr for Client's property. Launchstr retains the right to display completed work in its portfolio and marketing materials unless Client requests otherwise in writing.

Client grants Launchstr a royalty-free, non-exclusive license to use all photos, descriptions, and property information provided by Client for the purpose of creating marketing materials.

11. Cancellation & Refunds

The one-time setup fee is non-refundable once work has commenced. Monthly retainer fees are cancelable with 30 days written notice. No partial refunds are issued for mid-month cancellations.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

13. Entire Agreement

These Terms, together with any applicable service order or intake confirmation, constitute the entire agreement between Launchstr and Client with respect to the subject matter hereof. These Terms supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.

14. Modifications

Launchstr reserves the right to update these Terms at any time. Continued use of Launchstr services after posted changes constitutes acceptance of the revised Terms.
